8) Using the Services

While accessing or otherwise using the Services, you agree not to:

​

a) use the Services if you are not able to form legally binding contracts (for example if you are under 18 and are not able to involve your parent or legal guardian), or are temporarily or indefinitely suspended from using the Services by Foodify;

​

b) breach or circumvent any laws, third party rights or our systems, policies, or determinations of your account status;

​

c) post false, inaccurate, misleading, defamatory, libellous, obscene, child-pornographic, harmful, racially, ethnically, or otherwise objectionable content;

 

d) post or list content or items in inappropriate categories or areas, or post content unrelated to a listing;

 

e) list for sale illegal, counterfeit, or stolen items, or items that have been identified by police or other agencies as posing possible health risks to consumers and therefore subject to a recall, or items that have otherwise been identified by appropriate authorities as unfit for sale or distribution, or other unsafe items;

 

f) list any item on Foodify, or consummate any transaction that was initiated using the Services, that could cause Foodify to violate any applicable law, statute or regulation, or that violate the Agreement;

 

g) manipulate the price of any item or interfere with other users’ listings;

 

h) take any action that may undermine the feedback or ratings systems;

​

I) fail to pay for items purchased by you;

 

j) fail to deliver items sold by you;

 

k) fail to pay any taxes or charges in connection with the use of the Services or otherwise arising under this Agreement (for the avoidance of doubt, you shall be responsible for paying any and all taxes applicable to any sell or purchase of items you make by using the Services, excluding only taxes on Foodify's income);

 

L) fail to obtain and/or maintain all authorisations, approvals, consents, licences or permits from the relevant authorities, which are required to perform your obligations under this Agreement under all applicable laws and regulations;

m) transfer your Foodify account to another party without our consent;

 

n) knowingly act outwith the UK GDPR regulations and related legislation;

 

o) harvest or otherwise collect information about users, including email addresses, without their consent; 

 

p) distribute or post spam, unsolicited or bulk electronic communications, chain letters, or pyramid schemes;

 

q) distribute viruses or any other technologies that may harm Foodify, or the interests or property of Foodify users;

 

r) use any robot, spider, scraper or other automated means to access the Services for any purpose;

 

s) bypass our robot exclusion headers, interfere with the working of the Services, or impose an unreasonable or disproportionately large load on our infrastructure;

 

t) copy, modify, or distribute rights or content from the Services or Foodify's copyrights and trademarks;

 

u) copy, reproduce, reverse engineer, modify, create derivative works from, distribute, or publicly display any content (except for your own information) from the Services without the prior written permission of Foodify and any appropriate third party, as applicable;

​

v) commercialise any Foodify application or any information or software associated with such application; or

​

w) otherwise violate your obligations under this Agreement, or any applicable law, statute, ordinance or regulation, including, but not limited to, those governing consumer protection, unfair competition, anti-discrimination or false advertising.
